Introduction

SATELLAI respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how Satellai USA, LLC. and/or its affiliated companies (“SATELLAI”, “we”, “our”, or “us”) collects, uses, stores, transfers, protects, and otherwise processes personal information in connection with our mobile applications, smart pet collar products, and related services (collectively, the “Services”).

For the purposes of applicable data protection laws, Satellai USA, LLC. is the controller of the personal information described in this Privacy Policy, except where we expressly state otherwise. What Type of Information Do We Collect?

The categories of personal information we collect depend on how you use our products, mobile applications, and related Services.

Information You Actively Provide. When you register an account, activate a SATELLAI product, use our app features, contact customer support, participate in promotions, subscribe to communications, or otherwise interact with our Services, we may collect information you provide to us, including: name, email address, phone number, address, username, login credentials, customer service communications, products of interest, information you submit through the app or support channels and any other information you choose to provide.

If you subscribe to newsletters or promotional communications, we collect your email address so we can send you updates about products, features, promotions, surveys, and service-related information.

Pet Information. Because our products are designed for pets, we may collect information relating to your pet, including: pet name, pet birthday, pet breed, pet sex, pet photos, spayed or neutered status, shoulder height, body length, body condition score, weight, pet profile information, pet wellness or health-related insights generated through the services, resting respiratory rate, pet activity data such as running, walking, and resting, head-shaking activity, and pet medical documents.

Product and Device Information. When you use SATELLAI collar and tracking products, we may collect information about the products and devices connected to the Services, including: product serial number, firmware version, Bluetooth, IMEI, ICCID, product settings, device identifiers, device model, operating system version, log files, diagnostic information, error rates, usage duration, battery details, connection status, Telecom plan, network operator, connection type, basic hardware information, screen display information, device manufacturer details.

We may also collect information about the mobile device you use with our app, such as: IP address, app version, device type, operating system,unique device identifiers, browser or in-app environment details where relevant for app functionality, crash data and service performance information.

Location and Fence Information. To provide core functionality of our pet collar and tracking services, we may collect location-related information, including: precise location of your pet, your mobile device location where enabled through device permissions, fence or virtual boundary settings you create, saved safe zones and no-go zones, whether your pet is inside or outside a configured boundary, location history.

Information Collected Automatically. When you use our app, collars, beacons, and related Services, we may automatically collect information about how the Services are used, including: app interaction data, feature usage frequency, duration of use, device event logs, performance data, technical troubleshooting data, activity records needed to provide, maintain, and improve the Services.

Information From Other Sources. Where permitted by law, we may receive information from third parties, such as: business partners, analytics providers, service providers, social platforms, where you choose to connect or interact through such services. Such information may include profile details such as nickname or avatar, or other information relevant to providing the Services.

How Do We Use Your Information?

We use your personal information for a variety of business purposes, including:

To Provide Complete Services: We use your information to create and manage your SATELLAI account, register, activate, pair, and manage your products, provide pet location tracking, enable virtual fences and boundary management, provide pet activity monitoring, provide wellness insights and health-related alerts, support AI-powered pet analysis and related service features, help you monitor your pet’s status, movement, and rest patterns, provide customer support and technical support, respond to your requests and inquiries, respond to your requests for services. Additionally, we may use your information to address your customer feedback and provide technical support.  

For Marketing and Advertising Purposes: We use your information to send you marketing communications, updates on campaigns, products, and services we think you may be interested in. We also use your information to provide targeted advertising tailored to your interests in our products or services. The content of these communications may be customized based on our understanding of your preferences. You may opt out of marketing communications at any time as described below.

To Improve Our Products and Services: We use your information to Improve SATELLAI collars, beacons, app features, and related services, develop new product features and service functions, troubleshoot technical issues, improve tracking accuracy, device reliability, fence performance, and app usability,conduct analytics, testing, internal research, and service optimization, understand customer preferences and product experience.

For Security and Fraud Prevention: We may use your information to: protect our products, services, systems, and users, detect, investigate, and prevent fraud, abuse, unauthorized use, and security incidents, maintain system integrity and product safety.

For Legal Compliance and Protection of Rights: We may use your information to: comply with applicable laws and regulations, respond to lawful requests from authorities, enforce our terms, agreements, and policies, establish, exercise, or defend legal claims, protect our rights, property, safety, and the rights, property, and safety of others.

To Communicate with You: We use your information to communicate with you about  your queries when you contact customer service. We may also reach out to you about your feedback, this Privacy Policy, or our Terms of Service.

For Administrative Purposes: We may use your personal information for administrative purposes, such as: ensuring internal quality control and safety, authenticating and verifying individual identities and carrying out audits.

Use De-Identified and Aggregated Information: We may use personal information and related data to create de-identified, anonymized, or aggregated information for analytics, research, product improvement, and other lawful purposes. Where permitted by law, such information is not treated as personal information.

Other Uses: We may use your information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent or as permitted by law.

Where required by applicable data protection law, we process personal information only where we have a valid legal basis to do so. Depending on the circumstances, our legal bases for processing may include:

Performance of a Contract: where processing is necessary to provide the Services you request, such as creating your account, enabling pet tracking, maintaining virtual fences  and providing customer support.

Legitimate Interests: where processing is necessary for our legitimate interests or those of a third party, provided that such interests are not overridden by your rights and interests. This may include improving the Services, maintaining product security, preventing fraud, conducting analytics, troubleshooting technical issues, and supporting internal administrative operations.

Consent: where we rely on your consent, such as for certain marketing communications, certain use of precise location permissions, or the use of certain cookies, SDKs, or similar technologies where required by law. You may withdraw your consent at any time, but this will not affect the lawfulness of processing based on consent before withdrawal.

Legal Obligations: where processing is necessary for us to comply with applicable laws, regulations, court orders, lawful requests, tax obligations, accounting rules, or other legal requirements.

Protection of Rights: where processing is necessary to establish, exercise, or defend legal claims, or to protect the vital interests of an individual where permitted by applicable law.

The legal basis applicable to a particular processing activity depends on the type of personal information involved and the specific context in which we collect it.

Cookies, SDKs, and Similar Technologies

We and our third-party partners may use cookies, software development kits (“SDKs”), application programming interfaces (“APIs”), pixels, local storage, device identifiers, and similar technologies to operate and improve the Services.

- enabling core app functionality and authentication;

- remembering preferences and settings;

- understanding how users interact with the Services;

- measuring app performance and diagnosing crashes;

- fraud prevention and security monitoring;

- analytics and product improvement;

- measuring the effectiveness of communications and advertising; and

- where permitted by law, delivering or supporting personalized advertising.

Depending on the technology used and your jurisdiction, the information collected through these tools may include device identifiers, advertising identifiers, IP address, app version, operating system, language settings, usage events, in-app interactions, and diagnostic data.

Where required by law, we will obtain your consent before using non-essential cookies, SDKs, or similar technologies. You may also be able to manage certain permissions or preferences through your browser, device settings, operating system controls.

How Do We Share Your Information?

We do not sell personal information for monetary consideration.

We may share personal information with third parties in the following circumstances:

Service Providers. We may share any personal information we collect about you with our third-party service providers. The categories of service providers to whom we entrust personal information include service providers for: (i) the provision of the services; (ii) the provision of information, products, and other services you have requested; (iii)marketing and advertising; (iv)customer service activities; and (v) provision of IT and related services.

Business Partners. We may provide personal information to business partners to provide you with a product or service you have requested. We may also provide personal information to business partners with whom we jointly offer products or services.

Affiliates. We may share personal information with our affiliated entities.

APIs, SDKs, and Similar Technologies. Our app or Services may use third-party APIs, SDKs, and similar technologies that support functionality such as analytics, messaging, diagnostics, advertising measurement, or fraud prevention. These third parties may process certain device or usage information as necessary for those services.

Disclosures to Protect Us or Others. We may access, preserve, and disclose any information we store in association with you to external parties if we, in good faith, believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal processes, such as a court order or subpoena; (ii) protect your, our, or others rights, property, or safety; (iii) enforce our policies or contracts; (iv) collect amounts owed to us; or (v) assist with an investigation and prosecution of suspected or actual illegal activity.

Disclosure in the Event of Merger, Sale, or Other Asset Transfer. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, then your information may be transferred as part of such a transaction, as permitted by law and/or contract.

SATELLAI operates globally and works with affiliates, service providers, and partners located in different countries and regions. As a result, your personal information may be transferred to, stored in, or accessed from countries outside your country or region of residence.

Where required by applicable law, we implement appropriate safeguards for international transfers of personal information. These safeguards may include:

- entering into the European Commission’s Standard Contractual Clauses;

- relying on the UK International Data Transfer Addendum or other approved transfer mechanisms;

- relying on adequacy decisions issued by competent authorities where applicable; or

- implementing other lawful safeguards recognized under applicable data protection laws.

Please note that personal information transferred to other jurisdictions may be subject to lawful access requests by courts, law enforcement authorities, national security authorities, or regulators in those jurisdictions. These overseas jurisdictions may or may not have in place data protection laws which are substantially similar to that in your home jurisdiction. You have understood that the risks under applicable data protection laws are different and we may transfer to and store your personal information at overseas facilities. However, this does not change any of our commitments to safeguard your personal information in accordance with this Privacy Policy and applicable laws.

Your Choices

General. You may be able to opt out of certain uses of your personal information.  

Email Communications. 
If you no longer wish to receive promotional or marketing emails from us, you may use the unsubscribe option in the message or contact us at privacy@satellai.com. Even if you opt out of marketing messages, we may still send you transactional or service-related communications. 

Location Permissions.
You may control certain location permissions through your mobile device settings. Please note that disabling location permissions may affect important product functions, such as pet tracking, virtual fences, and related alerts.

Device Settings. You may also control certain app permissions and device-level settings through your operating system. Limiting these permissions may affect the functionality of the Services.

Your Privacy Rights

In accordance with applicable law, you may have the right to: (i) request confirmation of whether we are processing your personal information; (ii) obtain access to or a copy of your personal information; (iii) receive an electronic copy of personal information that you have provided to us, or ask us to send that information to another company (the “right of data portability”); (iv) object to or restrict our uses of your personal information; (v) seek correction or amendment of inaccurate, untrue, incomplete, or improperly processed personal information; (vi) withdraw your consent; and (vii) request erasure of personal information held about you by us, subject to certain exceptions prescribed by law; () not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

Automated Processing and Profiling

We may use automated tools to help analyze device performance, product usage, pet activity trends, service reliability, and related insights in order to operate, support, protect, and improve the Services.

We do not use solely automated decision-making that produces legal effects concerning you or similarly significantly affects you, unless expressly disclosed to you and permitted by applicable law. Where required by law, we will provide you with relevant information about such processing and your available rights.

Data Retention

As a general rule, we retain personal information for the period necessary for the purposes described in this Privacy Policy, or as required by applicable law. We will cease to retain and delete or anonymize personal information once the purpose of collection is fulfilled, or after we confirm your request for erasure, or after we terminate the operation of the corresponding services, except when required or permitted by applicable law, in which case, your personal information will be isolated and will not be further processed except for the attendance of legal responsibilities and other purposes permitted by applicable law. In such circumstances, your personal information could be made available exclusively to the parties permitted by applicable law. Once the corresponding retention periods have elapsed, such personal information will be deleted or anonymized.

Security of Your Information

We are committed to ensuring that your personal information is secure, and we will take all practicable steps to safeguard your personal information. However, you should be aware that the use of the Internet is not entirely secure, and for this reason we cannot guarantee the security or integrity of any personal information which is transferred from you or to you via the Internet.

In order to prevent unauthorized access, disclosure or other similar risks, we have put in place reasonable administrative, technical and physical controls and procedures to safeguard and secure the information we collect from your using of our services and our products. We will use all reasonable efforts to safeguard your personal information. For example, we use Secure Sockets Layer ("SSL") to encrypt your data when your data is transferred to us.

All your personal information is stored on secure servers. We make sure that our employees and third party service providers who access the information to help provide you with our services are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet such obligations.

By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our services and products. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our website or by sending an email to you.

Third Party Website/Applications

Our services and website may contain links to other website/applications and other website/applications may reference or link to our services or website. These third-party services are not controlled by us. We encourage you to read the privacy policies of each website and application with which you interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other website or applications. Providing personal information to third party website or applications is at your own risk.

Children's Information

Our Services and products are not directed to children under 18 (or other age as required by local law), and we do not knowingly collect personal information from children. If you learn that your child has provided us with personal information without your consent, you may contact us as set forth below. If we learn that we have collected a child’s personal information in violation of applicable law, we will promptly take steps to delete such information and terminate the child’s account.

Supervisory Authority

You have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates the applicable law.

Updates

We may update this Privacy Policy from time to time to reflect changes in our products, services, legal obligations, or privacy practices. When we make material changes, we will revise the effective date above and provide notice where required by law.

Your continued use of the Services after the updated Privacy Policy becomes effective will be treated as acknowledgment of the updated Privacy Policy to the extent permitted by law.
